Who needs an FSVP?

Under FSMA, the FSVP importer of human or animal food must have a written program showing that each foreign supplier produces food that meets U.S. safety standards. The FSVP importer is the U.S. owner or consignee of the food when it enters the U.S. If there isn't one, it's the U.S. agent or representative of the foreign owner, who must agree to the role in writing.

At every entry, the FSVP importer's name, email and D-U-N-S number are given to U.S. Customs. Shipments without a valid FSVP importer can be held or refused.

Amazon and online sellers: if you buy food abroad and ship it to the U.S. under your name, you are usually the FSVP importer.

What an FSVP includes

  • Hazard analysis for each food: biological, chemical and physical hazards that need control
  • Supplier evaluation of the food's risks and each supplier's safety record and certifications
  • Supplier approval before you import
  • Verification activities, such as a review of the supplier's records, sampling and testing, or third-party audits for the highest-risk hazards
  • Corrective action procedures if something goes wrong
  • Reevaluation at least every three years, or sooner if something changes
  • Records kept for at least two years and produced when FDA asks

What you receive from Regovant

  • A written FSVP for your foods and suppliers, prepared by an FSPCA-trained Qualified Individual
  • Hazard analysis and supplier evaluation records

The $369 setup covers one foreign supplier and up to 5 products. Each additional supplier is $169 and each additional product $69. We confirm the total in writing if you're unsure.

No U.S. company to be the FSVP importer? Foreign sellers, such as Amazon FBA sellers, can name Regovant as their FSVP importer. See our FSVP importer service.

How it works

  1. Tell us what you import: the foods, the suppliers and the countries. Ask for a quote if you have more than one supplier.
  2. We send a document checklist for each supplier.
  3. We prepare your FSVP from the supplier's documents and FDA's requirements.
  4. You receive your FSVP files and instructions for each shipment.

Who doesn't need an FSVP?

Some foods and importers are exempt or have simpler rules, including:

  • Juice and seafood from suppliers that follow FDA's juice or seafood HACCP rules
  • Certain meat, poultry and egg products regulated by USDA
  • Alcoholic beverages, under certain conditions
  • Food for research, personal use, or passing through the U.S. to another country
  • Very small importers, who follow modified requirements

We check whether an exemption applies before preparing your program.

Questions

Is FSVP the same as food facility registration?

No. Your foreign supplier registers its facility with FDA. The FSVP is the U.S. importer's own program for checking that supplier. Most importers need both: a registered supplier and an FSVP.

Do I need FSVP for dietary supplements?

Yes, with modified requirements for finished dietary supplements. Supplement ingredients have their own rules. We'll confirm which apply.

What happens if FDA asks for my FSVP?

FDA can ask for your FSVP records, and you must provide them promptly, generally within 24 hours of a written request. Your program needs to be complete and up to date before you import.
